Tenant woes

So I recently took over an apartment and the tenant has one month left on his lease, not renewing. He's been stalling the last payment and is now two weeks overdue :shakehea:

Presumably, he's hoping not to pay since I have to return him the one-month rental deposit anyway, but that gives me nothing to deduct against if there's damage found during the handing/taking over. He claims to have deposited a cheque on Thursday evening, meaning it should clear by Tuesday afternoon - tomorrow! Failing which, I should:

a. Retake the apartment without warning and just leave his lousy belongings in the corridor? Still need to collect door/mailbox keys from him.
b. Be nice and meet him? I can make time, but honestly I don't see why I should go to him.
c. Send professional debt collectors to his office to embarrass him? He's a 40-something, timid-sounding Singaporean bachelor working in a major U.S. bank.
d. What else?

Gimme all your ideas folks! OT away, no problem... just don't ask me to splash red paint on the door cos it's my own door hor :laughlik:

Did you buy over the apartment with tenancy? If yes, then you should contact the seller or the agent to handle the matter. If no, you should speak and meet the tenant in person to collect cash. It is obvious to me that he does not want you to hold the deposit for any deduction and intends to offset it against the last rental. If you drag on, he may choose to leave quietly just a few days before it is due to handover in order to avoid damages claims if there is any.

Finally got hold of the tenant just now to remind him I want to keep the rent and deposit separate. If no payment by tomorrow, my agent will show up same day to collect cash.

If he cooks up more excuses, guess I'll have to change the door code... O$P$. Calling Booby and his Yakuza Benz :yummie: And Terry's scary avatar!

Previous seller or agt wont bother. Not their prob anymore. I will juz call up my tenant and threaten to pass all my "late" mortgage interest payment to him. Works for me.

Was caught in a similar situation before.

Be nice because he may cause damage in your place - and honestly it may not be worth it just to be nasty. It sucks but you rather have your place intact, then he breaking a few tiles in retaliation.

Secondly, yes, state you keep rent and deposit separate. Are you married? Play good cop, bad cop. Blame your wife for being strict like this due to previous experience with ex-tenants and that she works in a law firm (he'll know not to mess around with you + an angry woman). Say you're caught in a tough place but if everything checks out fine on both ends, he gets his deposit back anyway.

My past experience is that the girlfriend threatened to report tenant to the police and give him a black mark so he couldn't come back to Singapore with a tainted record (this was some foreign tenant who was in the oil industry). Scared him enough to pay deposit plus one month for breaking contract.

Thanks for all the comments folks. The tenant finally paid up and will be gone in a couple of weeks, good riddance! :fineprin:
