uncle with trolleys fault!!!he blocked the taxi's view. but bmw saw him n flashed...cud hv e-braked perhaps.

insurance will say taxis fault. failure to stop. even tho bmw driver was speeding.

I would have picked on a TAXI + BMW combo but this selection is not available.

Uncle yet to cross. Not blocking cab driver's path in front. Cab driver moved out, and stopped for what? BMW could have braked if he did not assume that the cab will clear itself.

Speeding is not clear in the video, especially because camera car is moving in opposite direction. What's clear is taxi stopped in middle of the road.

To me the old mofo was blocking the taxi from turning and the bmw was swerving into the taxi from killing the old mofo.

BMW driver can flash but cannot brake? He may have the right of way but whatever happened to defensive driving.

Taxi's fault for stopping in the middle. BMW fault was driving over speed limit n not being observant. Uncle's fault for jay walking ...

So all claim own insurance

IMHO, It's taxi's fault, there were cars coming from both directions, even if he didn't see the BMW, there was the camera car, which also has the right of way.

Individually, none of the BMW's, taxi's, or old man's actions would have resulted in a crash. But put a little of BMW speed, Taxi's indecisive maneuvering, and old man's disregard for traffic, and it results in a painful and expensive crash.

We would love to say ALL OF THE ABOVE, but legal liability is different. Seems like the taxi will bear the burnt. Although the old man bo chap walk off and seems like he got the upper hand in the whole incident, one split second could end his life tragically.

The same goes for cyclists. Just like the old man, cyclists do not bear any brunt.

I would say BMW driver is naive. Where could taxi driver go with oncoming traffic from opposite direction?
