Side mirror knock by a van

I would like some opinion from you guys , i was knocked by a van cutting into my lane from the side and knock onto my side mirror , now refer to insurance company , what are the chances of winning , cause i heard from others outside is that sidesweep normally ended up with both parties at fault and will affect the NCD as well . Any suggestions ? Advise needed , really damn pissed off , was bang by others and yet affect the NCD?

if you did not on the spot get a signed statement from the guy, the chance is 50%50% even with solid photo prove also cannot win totally. my previous cut lane bang end up each of us pay for our own expenses. ncd not affected.

3yrs ago had an incident whereby the female driver tried to run but managed to catch up, overtook and forced her to stop.
her front right side side-swiped my left rear door to the rear fender and she even said she didnt know she hit someone.
refused to sign statement but i managed to take lots of pics to show her front hitting back half of car.
went to lawyer and managed to claim 70% all costs including lawyers fees and loss of use with my NCD totally untouched.
in your case, best is to take to specialist repair and insurance claim shop eg. lim tan and file claim.

to protect my wing mirror ... i always siam and be kiasi
very stressful especially bikes going through in-between cars at traffic light
encounter several near miss events when the biker make a wrong judgement of gap available ...

Could she have argued that you tried cutting into her lane, and it was your rear half hitting her front?

Bro,

in such cases, unless parties can prove their cases; it will be heading towards a 50/50 settlement. The reason being that no parties can prove their naration of the accident being the one that actually happened.

Going forwad, one of the cheaper ways to prove your innocence is to have a digital camera in your car. Take pictures of the accident immediately after the accident WITHOUT moving the vehicles so that it can show the "lane intrusion". This is critical for investigators and legal rep to prove your innocence. Off course taking the photographs should not take more than few mins so that you do not hold up the entire traffic ...

Last time my side mirror hit a Merc cab, his side mirror totally gone. I stop and give him number. He went to replace mirror, next morning call me, we meet at kopi shop, he show me invoice, I pay, and he buy me kopi.
BMW mirror damn strong because I only got a scratch.

Bro u met a saint taxi driver... Once I kissed a taxi's ass, a little bit dented... go for a PDR will do... other than paying for the damage... He want some compensation for loss of income for that 1hr... say morn peak hour he can earn alot... I suan him a small dent can still drive the taxi right, who ask u so stupid to go in the morning, can go during off peak what... He lan lan... :laughlik: knn wanna be terror with me :nutkick:
