Paragraph Title in Contract

Hypothetical question: Can any experts advise whether the title of a paragraph forms an integral part of the Contract. For example, if the title states "brand new car" but the wordings after the title states otherwise, can the purchaser still expect to receive a brand new car?

Re: Paragraph Title in Contract

The law favors substance over form

Re: Paragraph Title in Contract

In the eyes of the law, is the purchaser entitled to:

a) a brand new car; or

b) not so new car?

Re: Paragraph Title in Contract

or c) it can be argued both ways and the person who wrote the Contract should be taken to task?

Happened in real life just that the subject matter was changed to suit the car forum.
