Definition of Handphone Driving

Please take note of the definition of Handphone driving as defined by the Traffic police.

The appended was extracted from the TP website and TP now has the right to book such users as ignorance of the law is no excuse.

Handphone driving

An offence under Sec 65B of the Road Traffic Act is made out as long as there is evidence to show that the motorist was holding onto the handphone with one hand, while using it to communicate. This is regardless of the position in which he was holding onto the handphone and the fact that a hands-free kit was also used is irrelevant. Handphone driving is an inconsiderate and dangerous act that poses a threat to other road-users. The act distracts drivers and reduces their ability to control their vehicles and to react to changes in road situations. This puts other road users at risk. Because of the seriousness of the offence, Traffic Police will continue to step up our enforcement on handphone driving. We advise motorists who wish to use their handphones to have their passenger make or receive the call. If travelling alone, motorists should drive to a carpark before making the call.

Penalty

A first-timer convicted of phone and drive offence shall be liable to 12 demerit points and a maximum fine of up to $1000/- or to imprisonment for a term not exceeding 6 months or both.

He/She may also be disqualified from driving.

The offender's handphone and SIM card will be seized to facilitate investigation. These may be forfeited by the court upon conviction.

What constitutes HP driving

i) the driver of a motor vehicle that is on a road or public place "uses" a mobile phone while the vehicle is in motion using one hand to hold on to the mobile phone and the other hand holding the steering wheel communicate whilst driving

ii) Examples

Scenario A (Paging for someone)

Page for someone, with or without earpiece, using one hand to hold on to the mobile phone and the other hand holding the steering wheel.

Scenario B (SMS/MMS message)

Writing, Sending, and Reading SMS/MMS messages from someone, with or without earpiece, using one hand to hold on to the mobile phone and the other hand holding the steering wheel.

Scenario C (Making a Call)

Making a call, with or without earpiece, by pressing the keypads and was holding handphone in one hand with the other hand holding the steering wheel.

Scenario D (Receiving a Call)

Receiving a call, with or without earpiece, by pressing the keypads and was holding handphone in one hand with the other hand holding the steering wheel.
 
Actually kenna 12 points for one year and fine $200 for doing so last March. Phone confiscated for 1 month to "aid investigation."

Do not touch that phone when you are driving......
 
Hi Kenntona jus wondering lets say if my fren was caught n phone confiscated n didnt recieve letter for more than a mth+ would he be considered safe already?

Rick 1818 - I cannot speak for your friend's case, but I was caught red-handed. On the spot, TP issued summon to extract statement, keep my HP and SIM-card. 3-and-a-half-weeks later, go down to Ubi for statement, conceded offence, paid fine of $200, and take back my HP and SIM-card.

My view on your friend's case - safe, since he was not caught on the spot.

The TP stopped my fren n confiscated my fren's HP n SIM Card on the spot leh... But up till now my fren still hasnt recieved any notice frm TP.... Tats pretty weird.... Might be like almost 2mths already n he still din recieve anything.....

If that's the case, the demerit 12 points is a certainty. Gotta wait to give statement at Ubi......
 
i've heard conflicting opinions about this,

but is it an offence to use your handphone while your car is stopping at a red light?
 
i think it is RB.....
i think so long as u r on the road n in ur car and u so happen to touch the Mobile Phone then it seems like u can get caught for that cos tat was wat happened to my manager and he is a repeat offender so heard frm him that he has to go to court for this time round already.....(mobile phone n battery confiscated but SIM Card returned to him for my manager case)

The general rule of thumb by the TP is "both hands on the steering wheel, eyes on the road"

Pressing a button on your bluetooth headset to activate voice dial should be OK.

I believe somewhere on the website also mentions no eating & drinking while driving

Hmm..so one is deemed to have committed an offence if one places an arm on the arm rest while driving? :screwedu:

Steven, technically, probably Yes. :whattheh:

I find scenerio C & D to be significantly more trivial, and 12 pts in this case is quite harsh, considering that the driver may have an earpiece on.

One thing though, that is it'll be quite difficult for the TP to catch a driver who've just taken less than a second to press the "answer" button and I doubt they'll go to that extent to catch such "offenders". If caught, the driver is really down with his luck. :(

Don't bet on it, Alvin. I was trying to argue with the TP that I did not even answer the incoming call (which I did). His response? If need be, they will trace the calls with the operators as evidence. That is assuming you have the time to clear your call log on your HP......

Can you smoke in the car? Can you make a phone call at the traffic lights? Can you put your hand on the arm rest? Can you put your hand on your chio female passenger's thighs? ...... There is only one way to find out......

Personally, this is a freakin' joke.
 
i believe the need for rules still exist or drivers will have no disincentive to talk on the mobile. so while digging your nose while cruising on the PIE may be an offence in black and white, i dont think anyone would ever be booked for that. what they are really after are those who use mobile phones or sms whie on the move, and taking their concentration off the road.

i've seen idiots swerve left/right totally unpredictably in front of me before, like he was drunk and then i realised he was smsing on the phone when i finally plucked up the courage to zip past this lunatic.

i've also had a 7 series swerve into my lane at AYE yesterday, when the straight road started to become a slight left bend. The 7er on my left just shot straight on, meaning he swerved into my lane as the road curves left. I evaded him, and he suddenly jerked his car back into lane. I looked into the window, and his reading light was on and he was reading something in the car. these are the people the TP wants to target, so i suppose the chronic nose-picker shouldnt be too unduly worried in his mobile search for gold.
