Potential Lemon?

Just took ownership of my e70 X5 4.8i less than 2 weeks, of which I was away for 1 week and car in workshop 1 week...

4x4 and DSC fault.
Engine fault.
Active Steering fault.
Rear view camera faulty.
Boot lid open warning when closed.

Should I evoke Lemon Law? Car is now in PML at my insistence for full diagnostics.

Very handsome car but alas might be short lived...

Thx Seanskye! Bro Darth Vader, I didnt buy a brand new one. This car is pre-owned 2008 car. I'm 2nd owner. Still... I didn't expect so much trouble. Did STA inspection and test drive (10min) but nothing warranted my suspicion. Bro Jackiejb, any ballpark figure on cost of repair for 4x4?

It hard to estimate as the detail diagnosis not known... it could be 4x4 control module or absorber... x5 absorber is 1k per piece as I'm know... module is around few ks

Put dealer on notice immediately in writing.

I am enlisting CASE for help. Not sure if dealer is cooperative in repairs and stuff. If they do, they are still reasonable and abide lemon law. If so, I'll be doing them disservice. But if they behave like fly by night company then for sure I'll name and shame.

You would get those errors when the battery goes flat as well ...... If you sequence the reinitialisation of the ECUs in the correct order you may be able to clear all these errors.

Took ownership 2 weeks. Drove the car 2 days... damn sad... According to CASE, since lemon law, hardly any complaints end up with full refund. Many pre own dealers can be tough nuts to crack and refuse to cooperate. End up always both side lose some, no clear "winner"... Most cases end up discounted or repaired.

Forgot to mention before that the car gear automatically jumped from D to N and the car huff and puff itself into a dramatic stall...! I threw the car into pml for safety's sake!

I rather u put them on notice first. Then letter of demand followed by repairs and then claims...

so long as you have all the documentation to back you up, you can win in court ...

i took one of the big boys to court over 10 years ago ... they walked out with a new orifice ...

Got a call from the Technical Manager. Apparently the Active Steering problem is recurring and difficult to permanently eradicate. He stop short of saying BMW technology is f*** up. But the solution is to remove Active technology and replace with Normal Power Steering as a "permanent" fix. They will do it foc. Dealer is happiest person around lor... but repairs will take 1 month and dealer refuse to bear the rental cost in full... only 1/3 they pay. Have to let CASE help negotiate with them.

Tos, what is the outcome? To what extent can CASE help using lemon law or u need to sue?

I learnt thru the hard way that Lemon Law can be tough to execute, especially in getting full refund. In my case it's because dealer was willing to undertake repairs. However they insist on doing it outside of PML due to cost difference but I managed to come to a compromise with them. Car is now in PML for repairs. I'm removing the problematic Active Steering and some other faults which PML assured are fixable. I only hope after this the car drives just as well as it should.
