How to protect myself from unfounded accident claim

Just now driving along River Valley Road.
The silly driver of a black VW gti driving behind me approach me at traffic light and claimed that my car hit his car.
His claim is ridiculous.
My car in front. How to hit his car on the left side.
I came out of my car and every inch of my car is totally flawless.

My question is can someone just anyhow go make a accident claim against me.
If he really claim me. How to prove I am innocent.

If I am not mistaken, even if he dare to claim against you and you do not file a claim (since there's no accident / damage) with your insurer, there's nothing he can do.

Prob he has to suck thumb and claim his own damage (OD).

If he wanna claim against you, the onus is on him to provide witness or video proof. So not to worry

Re: How to protect myself from unfounded accident claim

U should report to police for record and standby to send to ur insurance company. Also, u shd have examined his car n damage n take pics of the damage.

If it's a scam I would str8 away call police n say that fella tried to hit you etc... n u shd just lie on the floor wait for police to come n then claim he already hit u...

Re: How to protect myself from unfounded accident claim

Just ignore him. He can't claim against you de.

Re: How to protect myself from unfounded accident claim

Yeah, just ignore... it's like a random psycho pregnant woman coming up to u and insisting that it's your child she's carrying..if she can't provide proof, no amount of reporting on her part is going to work.. if ur conscience is clear, don't need to fret about it...

Re: How to protect myself from unfounded accident claim

Actually can....the law allows you to make any claim subject to you proving it.

In this case, the VW driver may submit a claim through his insurers against is250 for any damage n as usual the insurers will then commence legal action against is250's insurers. Is250 then has to answer to the claim either by himself without his insurers or allow his insurers to handle it. Successful or not I dun know....coz for the VW driver to make an allegation means he "may" have some evidence.

my brother really did knock a taxi once, a mere scratch and tried to nego with the driver, who had a rusty face n refused...n just drove off. 2 weeks later a writ of summons arrived. Ccb claimed 4k!

Re: How to protect myself from unfounded accident claim

Truth of the matter, and what I tell my clients all the time, you cannot stop any other party making a claim against you, whether witrh merit or otherwise. The claimant would however have to prove the damage suffered and satisfy the court that the damages sought were caused by you and were reasonable in quantum. Since the onus is on the other party, just ignore, and tell the fella that making a false claim / police report is itself a crime.....

I usually also take out phone to take peekture and also give them my name card......

Re: How to protect myself from unfounded accident claim

Can I ask for advise? My car was hit by a lorry from the left, driven by an Indian worker. I was told by a claims executive if the Indian worker is not "driver" by vocation in his work permit, his insurer may not entertain any insurance claim. That means I have to make my own repair and settle via civil suit?
I was given the situation that the Indian/his company may not even report to their insurance, and my insurer will not be able to act or authorize the repair to my car if there's no resolution with the other insurance company
The only good way is to claim my own insurance, which I find ridiculous ! (as I believe I have right of way , and is not liable for the accident).
Seems like I am in a lan lan (pardon me) situation..... car kena quite bad. :(

Think it's not so simple. You can ignore but if your insurer has no balls and chooses the path of least resistance by paying up, you'll still get hit with a higher premium next time.

CCB gahmen!

Meaning what? That driver driving without a valid licence or driving without insurance?
