SINGAPORE: Thai teenager Nitcharee Peneakchanasakm, who lost both her legs in an accident at the Ang Mo Kio MRT station on 3 April 2011, has had her claims of negligence dismissed with costs.

Nitcharee Peneakchanasakm had sued SMRT and the Land Transport Authority (LTA) for S$3.4 million, contending that they had breached their duty of care in negligence and also failed to ensure the station was reasonably safe for passengers.

In his 81-page written judgment released on Thursday, Judicial Commissioner Vinodh Coomaraswamy said that while Nitcharee's injuries are undoubtedly tragic, the law of negligence awards compensation based on a defendant's culpability, and not simply the harm suffered by the plaintiff.

The judge also found that Ang Mo Kio station was "reasonably safe" at the time Nitcharee suffered her injuries.

As a result, the defendants -- SMRT and LTA -- are not liable in negligence for those injuries.

Based on video footage that was shown in court, Nitcharee was seen standing behind the yellow safety line. She suddenly fell forward, flipped over the edge and landed on the tracks. Seconds later, the train ran over her legs. She did not appear to have been pushed.

Ms Nitcharee was 14 years old when she fell onto the tracks at Ang Mo Kio MRT station in April 2011. She was on a month long holiday from Thailand and was attending English lessons in Singapore. She now attends school in Bangkok and has prosthetic legs fitted.

Despite the outcome, defence lawyer K Anparasan said Ms Nitcharee's injuries are tragic.

He said: "But at the end of the day, the court made a finding based on the law. The law makes a finding based on culpability meaning who is at fault, so the issue is whether the LTA and SMRT were at fault.

“The court made a finding of fact that Ang Mo Kio MRT station, from which she fell off, was reasonably safe at the material time. I think that is the standard the court looked at and that's an objective standard and we are complying with all the necessary safety features and in fact, it has exceeded certain jurisdictions like the US and UK."

The plaintiff has one month to appeal.

Ms Nitcharee's lawyer Cosmas Gomez said he will meet the family soon to decide on the next course of action.

Why would someone suddenly fell forward and flipped into an oncoming train without being pushed ?

I think the court is trying to say - "even if pushed, is that SMRT's fault? Is the AMK station unsafe?"

This happened to a fren of mine in new york many years ago where she was working. Standing on the platform she fell into the tracks and oncoming train hit her tragically.

The station is under the obligation to provide reasonable care to those using the premises... in this case, the standard of proof is reasonable precautions to prevent accidents that could be reasonably foreseen.

I wud agree with the decision.

1. Sudden blackout (it happens to all healthy people who may not even remember)
2. Slipped cos shoe soles wore out and just nice got bird shit there making your shoe a roller blade
3. Misjudgement of distance between platform and ledge

Pity the girl, but do not pity the facts of the case.

Initial reports seem to have suggested that she had passed out and fell onto the tracks. The whole story apparently then evolved into the case as it was presented; the girl (or her family) later said she was pushed instead and sued for S$3.4m. If you all remember, this was on top of SMRT paying for her bills and some token cash, plus the large amount of donations from Singaporeans.

When common law ceases to protect common sense, all hell will break loose. Imagine if the case was lost, how many people would you see trying to repeat the feat and use this as a precedent to sue for a fortune that most people will never see in their lifetimes.

Beyond emotions, I think the facts were presented and justice was upheld wisely.

The doors were not an afterthought. The LTA and SMRT had already started to install platform screen doors on elevated train stations way back in 2008.

However, due to the limited window of opportunity, they could only work for around 3 hours in the wee hours of the morning. Hence, it was a tedious project that took a very long time. Just like the railway sleeper replacement.

Nonetheless, even without the screen doors, the safety level of the stations already exceeded international standards.

The issue is - was the platform "unsafe" from a layman perspective? The court has deemed it to be "reasonably" safe.

its like stock brakes is reasonably safe but after someone crashes using stock brakes, they decided to change to BBK

Sad but fair outcome. The local MRT commuters are all sighing in relief - otherwise, fares will go up up and away again!

Not to mention even more people who will risk their lives to stage similar incidents to claim compensation on the basis of precedence. Along the way, killing the whole mass rapid system.

Tot there was one already? Though the whole incident was not staged n money didn't come from lta/smrt, public donations was in hundreds of thousands but later squandered away in 4ds n Toto... Tragic..

Well, sometimes the lawyer can be convincing that there is a case. Not saying all lawyers are such.

maybe was an issue of the tire e.g. lousy grip or worn, and not the brakes, how?
