not to alarm any e46 drivers here, but it seems like the folks in the US have managed to slap BMW for alleged inherent subframe defect.

anyone here had the same problem? how would we know, given that it's something we don't even see? preventive measures?

Lovely.

Except many loopholes for BMW USA to escape.
i think they've excluded a good 50% of U.S. BMW owners by default.
At least most of the folks on e46fanatics.
Poorly negotiated by the lawyers.

Excluded from the Class are:
(1) BMW NA, its subsidiaries and affiliates, officers, directors, and employees;
(2) Insurers of Class Vehicles;
(3) All entities claiming to be subrogated to the rights of Class Members;
(4) Issuers of extended vehicle warranties;
(5) Individuals who validly opt out of the settlement;
(6) Any judge to whom this matter is assigned, and his or her immediate family;
(7) Any current or former owner or lessee of a Class Vehicle whose Class Vehicle
was modified for racing, whether sanctioned or not;
(8 ) Any current or former owner or lessee of a Class Vehicle that has been modified
with suspension parts and/or wheels of a different size; and

(9) Any current or former owner or lessee of a Class Vehicle that has released his/her
claims against BMW NA related to the Sub-Frame Condition.

yeah... clauses 7 and 8 are the most interesting... this is everybody in e46fanatics... kekeke...

but what i'm more interested in is what exactly constitutes subframe failure. haven't heard this happening in over here...

Subframe failure happens over here as well, esp to the E36s. Just that there are no lawsuits against BMW here.

Whats causes subframe failure? Repeated flexing of metal sheets under stress cause it to crack/tear overtime. Its a design problem rather than material problem. When BMW designed the cars, they failed to notice the weak subframe mounting points. If they reinforce the mounting points, such things wouldn't happen at all.

TMS also has the same kit for E36!

TMS products are top notch and slightly cheaper than UUC.

managed to find a good example (in video too!) - YouTube - BMW 328i Rear Sub-Frame Damage

definition of subframe failure - where the subframe (on which almost everything is mounted on) is detached from the chassis. (ok, this is the layman's definition...)

symptoms - inpossible to ignore godawful clunking noises when driving, from the 'rattliong' of the subframe against the car body, and loss of stability especially during cornering. so basically impossible to ignore... :thinking:

fortunately, it predominantly affects cars manufactured before 2001. BMW apparently addressed this issue after that...

HUGE SIGH OF RELIEF!!! :nehnehhh:
